Toki Live - End User License Agreement (EULA) & Terms of Service

These terms of service ("Terms") and End User License Agreement ("EULA") apply to any user ("User" or "You") using the current and future versions of the video communication service ("Toki Live" or "TOKI") owned and provided by Mojab Innovation for Information Technology (the "Company", "We" or "Us"). Please carefully read these Terms before using Toki Live. By accessing and using Toki Live, You agree to be bound by the Terms and EULA set forth herein. If You do not agree with these Terms, please immediately terminate Your use of Toki Live.

CHAPTER 1. General Provisions

1. Purpose

The purpose of these Terms is to set forth the respective rights, obligations, and responsibilities of the Company and You with regard to Your use of Toki Live on Your personal device by downloading the service application ("TOKI APP") or accessing the service website ("TOKI Web").

2. Changes to These Terms

The Company reserves the right to modify these Terms as necessary. If changes are unfavorable to Users, the Company will provide a 30-day notice. Continued use of Toki Live after the effective date of any changes constitutes Your acceptance of the modified Terms.

3. Notification and Communication

The Company may notify Users of updates or changes through platform notifications or contact details provided by Users.

CHAPTER 2. End User License Agreement (EULA)

1. License Grant

The Company grants You a personal, limited, non-commercial, non-exclusive, non-assignable, revocable license to download, install, and use the TOKI APP for personal use. No rights to the source code are granted.

2. Compliance with Apple Guidelines

By downloading and using the TOKI APP, You agree to abide by the Apple App Store Guidelines, specifically those related to user-generated content, safety, and privacy.

3. User-Generated Content Guidelines

You agree that You will not submit any content that is offensive, abusive, defamatory, or otherwise objectionable. The Company reserves the right to remove such content and suspend or terminate offending accounts.

4. Prohibited Acts

You agree not to engage in illegal or harmful activities, including but not limited to:

• Harassing, abusing, or intimidating others.
• Posting offensive or inappropriate content.
• Violating the intellectual property rights of the Company or others.

CHAPTER 3. Content Moderation and Safety Features

1. AI-Based Content Moderation

TOKI employs AI-based content moderation to block and filter objectionable content, including offensive language, hate speech, and inappropriate images or videos. This system operates in real-time to ensure a safe and respectful environment.

2. User Agreement on Content Moderation

By using TOKI, You agree to the EULA and these Terms, which state that there is no tolerance for objectionable content. Any violations may result in suspension or termination of Your account.

3. Content Flagging System

Users can flag content they deem inappropriate or abusive. Flagged content will be reviewed by the Company's moderation team.

4. User Blocking Feature

Users can block other users if they find them abusive or inappropriate. Once blocked, the blocked user will not be able to interact with or contact the blocking user.

5. Objectionable Content Handling & Action

The Company will review and take appropriate action on reports of objectionable content within 24 hours, including removal of the content and the potential suspension or permanent banning of the offending user.

CHAPTER 4. User Responsibilities

1. Terms of Service and EULA Compliance

You agree to use Toki Live in compliance with these Terms, community guidelines, and other applicable rules. Failure to comply may result in the suspension or termination of Your account.

2. Age Restrictions

Toki Live is intended for Users aged 17 and above. By using the service, You affirm that You meet this requirement. Users under 17 are prohibited from using the app, and we encourage parents to use device-based parental controls to prevent unauthorized access.

3. User Data and Privacy

Users will be required to provide explicit consent to the collection and processing of personal data in accordance with GDPR and Apple's privacy policies.

CHAPTER 5. Data Protection and Privacy (GDPR Compliance)

1. User Rights

In compliance with GDPR, You have the right to:

• Access: View the personal data we hold about You.
• Rectification: Correct any inaccurate data.
• Erasure: Request the deletion of Your data.
• Data Portability: Transfer Your data to another service provider.

2. Data Retention

We will retain Your data as long as Your account is active or as needed to provide You services. Upon account termination, all personal data will be permanently deleted from our servers within 30 days, unless legally required to retain certain data.

3. Data Breach Notification

In the event of a data breach, You will be notified within 72 hours, in compliance with GDPR.

CHAPTER 6. In-App Purchases and Subscriptions

1. In-App Purchases

Toki Live may offer in-app purchases for features, items, or services. You will be charged according to the selected subscription plan upon confirmation of purchase.

2. Subscription Terms

Subscriptions may be auto-renewed unless canceled at least 24 hours before the end of the current period. Cancellation can be done through account settings in the TOKI APP or via the Apple App Store.

3. Refund Policy

All purchases are non-refundable. If You experience issues with the service, please contact us at help@tokilive.com.

CHAPTER 7. Limitation of Liability

To the extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages arising from Your use of Toki Live.

The total liability of the Company shall not exceed the amount paid by You for the service during the period leading up to the claim.

CHAPTER 8. Governing Law

These Terms and EULA are governed by the laws of the Kingdom of Saudi Arabia. Any disputes arising from these Terms shall be resolved in the courts of Saudi Arabia.
